1.1. The purpose of this Manual is to assist persons wishing to access information in terms of the Promotion of Access Information Act (PAIA), promulgated in March 2001 from the Company.
1.2. This manual is not exhaustive, nor does it comprehensively deal with every procedure provided for in the Act. Requesters are therefore advised to familiarise themselves with the provisions of the Act.
1.3. The manual provides an overview of records held by the Company and the processes that needs to be adopted to access such records.

3.1. In this manual, unless inconsistent with or otherwise indicated by the context, the following terms shall have the meanings assigned to them hereunder and cognate expressions shall have corresponding meanings, namely, –
3.1.1. “the Act” means the Promotion of Access Information Act, Act 20 of 2000 and its regulations, as amended from time to time;
3.1.2. “Company” means Claremart Auction Group (Pty) Ltd., a company duly registered in terms of the laws of South Africa, with registration number: 1997/009112/07;
3.1.3. “person” means a natural or juristic person;
3.1.4. “Republic” means the Republic of South Africa.
3.2. Any term not specifically defined above which is defined in the Act and/or the Constitution shall bear the meaning as ascribed to it in the Act and/or the Constitution as applicable. In the event of a conflict of definitions, the definition in the Act shall prevail over the Constitution and this manual, and the Constitution shall prevail over this manual.
4.1. Claremart Auction Group (Pty) Ltd. 7.2. The following is a list of operational records maintained by the Company and is utilised in the day to day running and administration of the company:

g. Internal Phone lists;
h. Policies and Procedures;
i. Minutes of Meetings;
j. Administrative information.
8.1. A person who wants access to the records must complete the necessary request form, as set out in Annexure 1, and the completed form must be sent to the address or fax number provided in this manual, and marked for the attention of the information officer.
8.2. The requester must indicate which form of access is required, and identify the right that is sought to be exercised or protected, and provide an explanation of which the requested record is required for the exercise or protection of that right. Proof of the capacity in which the requester is requesting the information.
9.1. A person who requires a copy of this manual can access it on the Company’s website or alternatively a hard copy may be obtained free of charge at any of our offices.
9.2. This manual is available for inspection by the general public upon request during office hours and there is no charge for viewing the manual at any of our offices located at the above-mentioned addresses.
9.3. Copies of this manual may also be requested from the South African Human Rights Commission at the address indicated below:

10.1. A fee will be required by the head (contact person) before further processing of the request in terms of section 54 of the Act.
10.2. A requester fee of R50 should be paid, this amount will be refunded should the request for access be refused.
10.3. A portion of the access fee (not more than one third) may be required before the request is considered.
10.4. The head may withhold a record until the requester has paid the applicable fees.
11.1. The South African Human Rights Commission has compiled a guide containing such information as may be required by a person who wishes to exercise any right contemplated in the Act. The guide to this Act may be accessed at the SAHRC website at the address noted below.
